Central Huron Councillors has received an update on the county's proposal to address a conflict in the municipal zoning for AG4 properties and the Nutrient Management Act.
Planner Monica Walker-Bolton said the issue is that the municipal zoning restricts the number of animals allowed on AG4 properties. The Nutrient Management Act does not. But where they both address the same issues, the Nutrient Management Act supersedes the municipal zoning.
Walker-Bolton told council that the recommendation from Planning Director Sandra Weber is the wording around the restriction of livestock units be taken out of the AG4 zoning bylaw and if the number of livestock on a small property becomes an issue, the Nutrient Management Act would address it.
“Or there may be some restrictions about the nuts and bolts that are inside that barn that may have to be renovated to make it not possible to bring more livestock units into there without a building permit because a building permit would trigger the Nutrient Management Act,” said Walker-Bolton.
She said the county is still considering its options and will work with the municipalities to determine what changes they have to make.
