Woman accused of making child pornography gets bail

A Chatham woman accused of making and selling child pornography has been released on $7,500 bail with a residential surety.

The name and age of the accused woman are protected by a publication ban that is in place to protect the identity of the victim(s).

The publication bans fall under two sections of the criminal code:

  • Section 486.4 provides for orders restricting publication of information that could identify a complainant or witness in a sexual offence and 486.5 deals with publication bans on information revealing the names of victims, witnesses and justice system participants, where the order is deemed necessary for the proper administration of justice.
  • Section 517 publication bans may be ordered at bail hearings, and typically cover all evidence, information, what is said in court by all the parties, and the reasons for release or detention given by the justice.
The woman is being released on certain conditions.

She must not be within 100 metres of the victim, she must be supervised whenever she uses a cell phone or computer and must be supervised when around anyone under the age of 16, unless accompanied by her surety. There is also a weapons ban in place.

The accused was released to a surety.

Her next court appearance is scheduled for August 27, 2019 at 9 a.m.
