Fatal Impaired Driving Charges Dropped

Charges against a 19-year-old Leamington man involved in a double fatal crash have been withdrawn.

Based on the strength of the case, the Crown’s office, in consultation with Chatham-Kent Police, sayS there was no reasonable prospect for a conviction of Johan Bergen. Investigators say Bergen was driving the vehicle on February 5, 2012 when it crashed at Coatsworth Rd. and Herman Line, south of Tilbury.

The crash claimed the lives of 17-year-old Frank Wiebe and 18-year-old Jake Fast, both of Leamington. It wasn’t until April 25, 2013, more than a year after the crash, that police charged Bergen with two counts each of impaired driving causing death and dangerous driving causing death.

The Crown’s office has declined to give the specific reasons for dropping the charges.
