DiCarlo Relieved Lawsuit Dropped

Amherstburg Mayor Aldo DiCarlo is relieved to see a $9-million lawsuit against the town dropped.

"That is a very large, heavy stone that's been hanging around our neck," says DiCarlo.

He says financial implications of the lawsuit would have placed a heavy burden on taxpayers in the town.

"It was something that we would have had to consider in the future and now we don't anymore so, that really puts us in a really good financial position to not have to deal with that," says DiCarlo.

The town could have been on the hook for $4-million if a payout was necessary, but DiCarlo says the town didn't budget any money for that purpose.

"Probably [would] not [have been] very responsible in that respect, because what would it have meant as that trial unfolded?" says DiCarlo.

The lawsuit — which had 75 plaintiffs attached — was related to flooding in the town in August of 2011. The town received notice in March the plaintiffs wanted to end the legal action.

DiCarlo says the lawsuit being dropped means the town isn't facing any serious litigation.

"In big numbers, I can honestly say that was the last of them," says DiCarlo. "We've had two or three cases dropped, settled in the last few months and that was absolutely the biggest one."
