A disclosure issue is holding up court proceedings for four Tilbury dog-fighting suspects.
John Robert, Kim Robert, Michael Gagnon, and Robert Tomlin have a long list of animal cruelty charges against them after Chatham-Kent police broke up an alleged dog-fighting ring in Tilbury back in October 2015. Tomlin was arrested in March, but his case has since been grouped in with the other three suspects.
On September 21, a judge signed off to allow the defence to see a copy of the search warrant used for Tomlin's arrest. Lawyer Frank Retar says he and his client haven't seen them yet, and feels the matter has been "stalled."
During court proceedings Monday, officials told a judge the Crown lawyer handling the case has been away dealing with a "family matter." The judge speculated that this could be why Retar and his client haven't seen the warrant documents.
The case for all four suspects has been put over to October 6, with the hopes that the disclosure can be obtained, and pretrial matters can move forward.
